General terms and conditions of business

1. general

The following terms and conditions shall apply exclusively. Deviations from these terms and conditions shall only apply if they have been confirmed in writing by Trikombin Austria - Peter Lindpointner (in short: Seller).

2. prices

The current prices are valid, which can always be seen in the online store of Trikombin Austria. 

3. professional protection

Trikombin devices, Trikombin accessories, DTS test kits, Trikombin licenses & libraries can only be purchased by physicians, therapists, alternative practitioners or health care institutions. 

4. resale products

All products in the online store are considered as resale products except for: Trikombin instruments, Trikombin accessories, DTS test boxes, Trikombin licenses & libraries!

5. resale prices

Resale prices or quantity discount prices are only for doctors, therapists, alternative practitioners, health care facilities and trade. Resale product discounts vary and can be requested from Trikombin Austria at any time. 

For existing customers the resale discounts are also automatically deducted when ordering in the online store, even if the resale customer orders in the online store with the normal end consumer prices. 

5.1 Resale products are: 

Zappers and Zapper accessories, as well as chip cards. Vitamins, minerals, nutritional supplements, books, Nutraxmedix products and E-blockers from Mannayan! 

5.2 What are not resale products:

Trikombin devices, Trikombin accessories, DTS test boxes, Trikombin licenses & libraries are generally no resale products, where therefore no resale discount can be deducted.

Synbiotica & Probiotics from Vitality as well as the products from Dr. Niedermaier are no resale products at Trikombin Austria. Therefore no resale discount can be deducted.

5.3 How to become a reseller: 

You can be listed as a reseller after submitting the appropriate proof. Contact us here and send us the appropriate proof to office@trikombin-österreich.at. Reseller discounts are sometimes only granted for cheaper products if larger quantities are purchased. In general, the purchase quantity must clearly represent a resale quantity over the course of the year. Resale discounts will not be granted to companies that use our products for their own use only.  

5.4 Diamond Shield Zapper Resellers: 

If you already order at least 3 Diamond Shield Zappers with your initial order, you will automatically be listed as a reseller! If you order 1 or 2 Diamond Shield Zappers with your first order, you will get the reseller discount on the first 2 Diamond Shield Zappers credited with your next Diamond Shield Zapper order. You can then deduct this credit from your subsequent Diamond Shield Zapper order. In addition, between the first order under 3 zappers and the next order to get a resale discount credited, a maximum time gap of 12 months applies!   

Trikombin doctors and therapists are automatically resellers!

6. shipping costs

Austria: From an order value of € 100,- gross the shipping costs within Austria are free. On request we can also ship by EMS. In this case, the costs will be charged to the recipient, regardless of the purchase value. 

Shipping costs or shipping to neighboring countries: 

Depending on the product and order value, the shipping costs are charged by us individually after the order additionally to the customer.

Shipping costs to Switzerland: 

The costs for export from Austria, import to Switzerland, customs clearance and Swiss taxes are to be paid by the customer. These will be charged either by the supplier directly to the customer or by Trikombin Austria to the customer. 

The shipping costs to Switzerland will be paid by Trikombin Austria from an order value of € 1500,- net! The shipping costs to Switzerland are at least € 69,- depending on the package weight. The corresponding costs will be additionally charged to the customer separately after the online order. 

7. delivery

Delivery is usually within 3-4 business days on goods in stock. Goods that are not in stock will be shipped as soon as possible. Certain products may not be shipped to all neighboring countries. We reserve the right to refuse online orders. In this case, money already paid to us e.g.: by credit card would be automatically refunded.

8. payment method

• New customers and end users: Generally against prepayment or by credit card in the online store!
• Existing customers like doctors, therapists and resellers: 20 days net!
• Purchase of a tricombination device with accessories: Only against prepayment! 

9. Product- Return of goods

• Basically the return of products, goods e.g. DTS therapy ampoules, used chip cards, opened packages of consumables, opened dietary supplements in case of or intolerance after taking, books, etc. is excluded.
• The return of a zapper is possible only within 30 days under the following conditions. From the first use, the wrist cuffs, belly belts, ... etc. for hygienic reasons, as well as all cables with traces of use will be charged. Should the zapper, as well as the fractal antenna show signs of use, a return is excluded.  
• The return of a tricombination device is only possible if this has been agreed separately when ordering. A right of return of a tricombination device can be agreed to a maximum of 4 weeks (28 days) from delivery. If a return has been agreed and the device shows signs of use, a return is no longer possible at the original price. A corresponding devaluation will be determined by the seller depending on the traces of use or possible damages. Additionally purchased licenses or libraries are always to be deducted in case of a return.   
• In case of a return the postage costs will not be refunded. Except in the case of delivery of defective goods! In this case the goods will be exchanged and resent without additional shipping costs. 

10. leasing offers

For Trikombin purchasers there is the possibility of leasing the equipment. Trikombin Austria establishes the connection to a leasing bank. For equipment leasing you have to be self-employed for at least 18 months! In case the leasing bank does not handle a leasing with the customer due to lack of liquidity or due to lack of a business concept, Trikombin Austria Peter Lindpointner is generally to be held harmless. Therefore, no purchase contract between the customer and Trikombin Austria Peter Lindpointner shall be created or, if a purchase contract has already been created, the purchaser shall ensure that the equipment is financed otherwise or the purchase contract shall be declared invalid. The full scope of the initial equipment including all test vials and licenses and libraries can be leased.

11. lease-purchase

For Trikombin purchasers there is in principle the possibility of an installment plan. The hire-purchase option is limited on a yearly basis, which means that Trikombin Austria cannot make a hire-purchase offer to other interested parties if there is already a high contingent of hire-purchase equipment in the respective year. The contingent depends on the general market situation.  

Prerequisites: 

• An appropriate business concept for at least 3 years is to be submitted to Trikombin Austria Peter Lindpointner.
• Test ampoules cannot be included in the rental purchase. 
• Licenses and libraries can be included in the lease purchase. 
•  In the first 12 months a return of the Trikombin is generally not possible. From the 12th month a return is possible monthly. The return of the device must be announced in writing at least 3 months before the desired return date.  
• The hire-purchase variant can be agreed for three or a maximum of four years. Only when the last installment is paid in full, the device with the ordered licenses and libraries passes into the ownership of the buyer. 

Further conditions: Installment plan is agreed directly with Trikombin Austria. In case Trikombin Austria Peter Lindpointner refuses the lease-purchase option, Trikombin Austria shall be held harmless in general. Therefore, no purchase contract between the customer and Trikombin Austria Peter Lindpointner is created or in case a purchase contract has already been created, the buyer has to take care to finance the equipment otherwise or the purchase contract has to be declared as invalid. 

The monthly installments paid until the time of return, are considered pure rent and can not be deducted or offset in any other way. In addition, in the case of untypical signs of use for the duration of the rental period or in the case of improper handling or damage, an additional appropriate devaluation may be determined by the Seller, the cost of which resulting from the evaluation will be additionally charged by the Seller to the Customer. The monthly rental costs will be determined in advance, taking into account appropriate deposited bank charges and interest upon conclusion of the contract, and will be submitted as an offer to the customer for corporate signature.

12. revocation

If an order is revoked, the costs incurred thereby shall be borne by the customer.

13. reservation of proprietary rights

The products remain the property of Trikombin Austria - Peter Lindpointner until full payment has been received.

14. warranty

On a new Trikombin device we grant 3 years from the date of shipment!

On a new Zapper we grant 2 years from date of shipment!

Damages caused by the customer or user are not covered by warranty!

15. seminars of Trikombin Austria

• 15.1 Trikombin Austria Peter Lindpointner is the organizer of the offered trainings. For the respective training contents, which are accomplished by the individual instructors, these are responsible and also liable. 
• 15.2 The event fees will be determined for the individual seminar and workshop events. 
• 15.3 Registrations will be processed according to the date of receipt (postmark or email data). The maximum number of participants in the seminars/workshops will be determined according to the type of event. Registrations have to be made in writing only (mail, post, registration form on the homepage) and are binding. An online registration is binding after accepting the terms and conditions. Verbal agreements are not valid. Reservations will not be made. If the course places are completely occupied before the beginning, a waiting list will be created. 
• 15.4 After receipt of the registration, a confirmation of order will be sent, stating the amount of the deposit and the date of payment. The amount of the deposit is 30% of the total amount. The participation place is only firmly reserved after receipt of the down payment. If this is not the case, Trikombin Austria Peter Lindpointner reserves the right to allocate the respective event place if there is a waiting list.
• 15.5 The complete event fee is to be paid at the latest 6 weeks before the start of the event according to the stated payment condition of the order confirmation for the final amount (see above). If this is not the case, Trikombin Austria Peter Lindpointner reserves the right to allocate the respective event place if there is a waiting list. In this case the already paid deposit will not be refunded. In case of registration within 6 weeks before the beginning of the event, the complete event fee has to be paid immediately with the registration.
• 15.6 Cancellations must be made in writing up to 6 weeks before the start of the respective event and are only valid after receipt of a written confirmation of cancellation (by e-mail, mail or fax) from gesund beschwingt KG. The paid fees will be refunded minus a handling fee of € 20,00 in this case. In case of cancellation 6 weeks or more before the start of the respective event, 100% of the booked service will be charged. Should the originally booked seminar/workshop be rebooked on another date, the cancellation fees will not apply. 
• 15.6.1 If the participant is prevented from attending the event, he/she may transfer the contractual relationship to another person. The transfer must be communicated to the organizer in writing. The transferor and the transferee shall be jointly and severally liable for any unpaid fees and, if applicable, for any additional costs incurred as a result of the transfer. 
• 15.7 Liability for personal injury and property damage at events organized by Trikombin Austria Peter Lindpointner is excluded to the extent permitted by law. Participation in the events shall be at one's own risk. 
• 15.8 Trikombin Austria Peter Lindpointner expressly reserves the right to change the advertised events, dates and schedules. This also applies in case of a short-term prevention of the event leader or a speaker. In this case, Trikombin Austria Peter Lindpointner will endeavor to find an equivalent replacement. If this cannot be guaranteed, the date shall be rescheduled to a later date. 
• 15.8.1 If the number of participants is too low, an event may be cancelled without replacement or postponed to a later date. Payments made (deposits or event fees) by the participants will then be refunded in full and without delay. Further claims against Trikombin Austria Peter Lindpointner cannot be asserted. The participants will be informed in time (max. 1 week before the date) in case of cancellation!
• 15.9 Documents for the events can be issued in printed or electronic form (.pdf). It is expressly pointed out that the copyrights to the event documents (scripts, copies, etc.) remain with Trikombin Austria Peter Lindpointner or the respective author and writer of the documents. There is no right to printed script documents. 
• 15.10. Trikombin Austria Peter Lindpointner uses personal data such as surname, first name, address data, date of birth, job title as well as email addresses and telephone numbers exclusively for information purposes (e.g. newsletter) or advertising of events Trikombin Austria Peter Lindpointner. By accepting the terms and conditions at registration, participants agree to this. Participants can object to this at any time. This objection must be made in writing (email is sufficient). 
• 15.10.1 In the course of our events, photographs and/or films may be made by or on behalf of Trikombin Austria Peter Lindpointner. By registering for the event, you acknowledge that photographs and video materials on which you are depicted may be used for press coverage and published in various (social) media, publications and on websites of Trikombin Austria Peter Lindpointner.
• 16 General Provisions
• Verbal collateral agreements are invalid. Changes, additions and supplements must be in written form and must be countersigned by Trikombin Austria - Peter Lindpointner. The invalidity of individual conditions for any reason whatsoever shall not affect the validity of the remaining conditions. The sales contract (order in the online store) is therefore not dissolved.  

17 Jurisdiction

Austrian law shall apply exclusively; the place of jurisdiction shall be the court with subject-matter jurisdiction for Mondsee.              

18. privacy policy

The personal data collected in the online store can be used for the fulfillment of business purposes within the legal data protection regulations of Trikombin Austria Peter Lindpointner. This consent can be revoked at any time in writing by e-mail to office@trikombin-oesterreich.at.
